1Acceptance of terms

By accessing this website or engaging Brand Booster (a trading name of BMM Digital) for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or our services.

These terms apply to all visitors, enquirers and clients. Where a separate written service agreement or statement of work exists between you and Brand Booster, that agreement shall take precedence over these general terms.

2Our services

Brand Booster provides Amazon marketplace management services including but not limited to:

• Amazon PPC campaign management (Sponsored Products, Brands, Display, DSP)
• Listing optimisation and copywriting
• A+ Content and Amazon Brand Store design
• Amazon Brand Registry and intellectual property protection
• Amazon account setup, launch and full account management
• Amazon Marketing Cloud analytics and attribution

The specific scope of services for any client engagement is defined in a separate proposal, statement of work or retainer agreement. Nothing on this website constitutes a binding offer to provide services.

3Client engagement

All client engagements commence upon execution of a written agreement and receipt of any required onboarding payment. The client agrees to:

• Provide Brand Booster with necessary access to Amazon Seller Central, advertising accounts and any other platforms required to deliver the agreed services
• Supply accurate business information, brand assets and product details in a timely manner
• Designate a primary point of contact responsible for approvals and communications
• Respond to requests for approvals within the agreed timelines to avoid delays

Brand Booster will not be liable for delays or underperformance caused by the client's failure to fulfil the above obligations.

4Fees & payment

Fees are as agreed in your individual service proposal or retainer agreement. Unless otherwise stated:

• Retainer fees are billed monthly in advance
• Invoices are due within 14 days of issue
• Late payments may incur interest at 2% per month
• Ad spend is billed directly to the client's Amazon account and is not included in management fees
• All fees are quoted exclusive of VAT where applicable

Brand Booster reserves the right to suspend services for accounts with outstanding invoices exceeding 30 days.

5Intellectual property

Client materials: All brand assets, product imagery, trademarks and other intellectual property provided by the client remain the sole property of the client. Brand Booster is granted a non-exclusive licence to use these materials solely for the purpose of delivering the agreed services.

Deliverables: Upon receipt of full payment, ownership of deliverables created specifically for the client (such as listing copy, A+ content and brand store designs) transfers to the client.

Brand Booster materials: Methodologies, processes, templates, tools and frameworks developed by Brand Booster remain the exclusive intellectual property of BMM Digital, regardless of whether they were used in the delivery of client services.

6Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement, including business strategies, financial data, campaign performance and trade secrets. This obligation survives termination of the engagement for a period of 3 years.

Brand Booster may reference the client's brand name and general results in marketing materials (such as case studies) unless the client requests otherwise in writing.

7Limitation of liability

Brand Booster provides Amazon management services with skill and care, but cannot guarantee specific revenue outcomes, ranking positions or advertising results, as these are influenced by Amazon's algorithm, market conditions and factors outside our control.

To the maximum extent permitted by applicable law:

• Brand Booster's total liability for any claim arising from our services shall not exceed the total fees paid by the client in the 3 months preceding the claim
• We shall not be liable for indirect, consequential, incidental or punitive damages
• We are not liable for account suspensions, listing removals or policy violations caused by Amazon's decisions or actions taken at the client's direction
• We are not liable for losses arising from the client's failure to maintain accurate product information or comply with Amazon's policies

8Termination

Either party may terminate an ongoing retainer engagement by providing 30 days written notice. Fees for the notice period remain due and payable.

Brand Booster may terminate immediately and without notice if the client:

• Fails to pay invoices within 45 days of the due date
• Breaches these terms in a material way that is not remedied within 14 days of written notice
• Engages in fraudulent, illegal or harmful activity

Upon termination, Brand Booster will provide reasonable assistance to transition account access and any relevant materials back to the client within 14 days.

9Warranties & disclaimers

This website and its content are provided "as is" without warranties of any kind. We do not warrant that the website will be uninterrupted, error-free or free of viruses.

Performance metrics and case study results displayed on this website represent specific client outcomes and are not guarantees of results for any other client. Past performance is not indicative of future results.

10Governing law

These terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11Changes to these terms

We may update these Terms and Conditions from time to time. Material changes will be communicated to active clients. Continued use of our services after changes are posted constitutes acceptance of the revised terms. The date at the top of this page reflects the most recent update.
